A Residential Sublease Agreement is a legal document that allows a tenant to transfer all or part of their rental rights to another person, called the subtenant.
Under a Residential Lease, a landlord grants a tenant the right to occupy a home or apartment. However, the tenant may choose to sublet the property, meaning they rent it out to someone else for a period of time. In a sublease, the subtenant pays rent directly to the tenant, while the tenant continues to pay rent to the landlord and remains responsible for following the terms of the original lease.
There are two main ways a sublease can be arranged:
The tenant moves out of the rental property entirely. The subtenant takes full possession and pays rent to the tenant.
The tenant rents out part of the property while continuing to live in the remaining space. For example, a tenant in a two-bedroom apartment may rent one bedroom to a subtenant and keep the other for personal use.
Important: A tenant can only sublet if the original lease allows it or if the landlord gives written consent. This document is intended only for residential properties. If the property is used for business purposes, a Commercial Sublease Agreement should be used instead.

In Lagos State, the Tenancy Law of Lagos (2011) applies to all residential rental properties. In other states across Nigeria, the tenancy laws of the respective state govern residential lease and sublease agreements.
