A Notice to Quit is a formal letter issued by a landlord to a tenant, requesting that the tenant vacate the rented property. This notice informs the tenant of the landlord's intention to end the tenancy and recover possession of the premises. The landlord is the property owner who has rented out the premises to the tenant in exchange for payment of rent.
Tenants may receive a Notice to Quit for several reasons, including but not limited to:
- Non-payment or late payment of rent
- Engaging in illegal activities on the property
- Causing nuisance or disturbance
- Breaching the terms of the Lease or Tenancy Agreement
The notice specifies how long the tenant has to leave the property. It also includes key details such as:
- Names of the landlord and tenant
- Address of the property
- Type of tenancy (weekly, monthly, yearly, etc.)
- The date when the notice will expire
The type of tenancy determines how much notice the tenant is entitled to.
When a Notice to Quit is Required
A landlord who wishes to recover possession of a property under a periodic tenancy or before the end of a fixed-term tenancy must first issue a Notice to Quit. If the rental agreement does not specify the notice period, the law determines it based on the type of tenancy:
Periodic Tenancy
This type of tenancy continues for set periods until ended by either party. Examples include weekly, monthly, quarterly, half-yearly, or yearly tenancies.
The legally required notice periods are:
- Yearly tenancy: 6 months' notice
- Quarterly or half-yearly tenancy: 3 months' notice
- Monthly tenancy: 1 month's notice
- Weekly tenancy: 1 week's notice
Fixed-Term Tenancy
This tenancy runs for a specific period agreed by both parties. Once the term expires, the tenant must vacate the premises unless the agreement is renewed. The landlord is not required to issue a Notice to Quit after the term ends but must serve a 7-day Owner's Intention to Recover Possession.
Tenancy at Will
This tenancy can be ended by either the landlord or the tenant at any time. It usually exists without a written agreement. In this case, the landlord or agent must issue a 1-week Notice to Quit.

Applicable Laws
In Lagos State, the main law governing this process is the Rent Control and Recovery of Residential Premises Law and the Lagos State Tenancy Law of 2011. Other Nigerian states also have their own tenancy laws that apply to similar situations.
