A Roommate Agreement is a written document that outlines the rights and responsibilities of two or more individuals who choose to share a rented property.
Living with one or more roommates can help reduce accommodation costs, but it can also lead to conflicts or misunderstandings if expectations are not properly agreed upon. This agreement allows all roommates to clearly set out the rules and arrangements for living together, helping to maintain a peaceful and cooperative household.
This document is different from a Residential Lease Agreement, which governs the relationship between a landlord and tenant. A Roommate Agreement, on the other hand, regulates the relationship among the tenants or occupants sharing the same rental unit. For example, it may be used when two or more people share an apartment, house, or flat and use common areas such as the kitchen, sitting room, bathroom, or even a bedroom.
The agreement usually covers important matters such as:
- Quiet hours and acceptable noise levels;
- Cleaning and maintenance of shared spaces;
- Rules about visitors or overnight guests; and
- Whether pets are allowed on the premises.
By agreeing to these terms in writing, each roommate understands what is expected of them, reducing the likelihood of future disputes.
How to Use This Document
This document should be used when two or more people intend to live together in a rented property and want to set out each person's responsibilities in writing.
It should specify details such as:
- How much rent, security deposit, and utility bills each roommate will contribute;
- Payment terms, including due dates and payment methods; and
- House rules, including how shared areas should be used and maintained.
After completing the document, it should be printed and signed by all roommates. Alternatively, the document can be signed electronically. Each roommate should keep a signed copy for their records.
Applicable Law
This agreement is governed by the general principles of contract law in Nigeria. It is not a substitute for a tenancy or lease agreement with the landlord, but it supports harmonious living among co-tenants or occupants.
